These purchase terms and conditions (hereinafter – Terms) set out the mutual rights, obligations and responsibilities between UAB "Omgema" (hereinafter – the Seller) and the Client (hereinafter – the Buyer) when purchasing goods in the Seller’s online store or physical points of sale.
By purchasing goods, the Buyer confirms that they have familiarised themselves with these Terms and undertakes to comply with them.
1. General provisions
1.1. The goods are sold by UAB "Omgem", company code 234853110, registered office address: Jonavos g. 68E, Kaunas, LT-44191, Lithuania, e-mail: info@sextantasy.lt
1.2. Goods may be purchased by all legally capable natural persons (from 18 years of age) and legal entities.
1.3. The Seller reserves the right to change or supplement the Terms at any time. The updated Terms are published on the website.
2. Goods and ordering
2.1. The goods are presented in the online store with photos, descriptions and prices.
2.2. Product photos may be for illustrative purposes only – the actual product may slightly differ in colour, shape or packaging.
2.3. The order is considered submitted when the Buyer fills in the order form in the online store and pays for the goods or chooses another payment method.
3. Prices and payment terms
3.1. All product prices are indicated in euros (EUR).
3.2. Delivery costs may be added to the product price, which are indicated at the time of placing the order.
3.3. The Buyer may pay:

by bank transfer;

in cash or by card when collecting the goods on site (if such an option is provided).
4. Delivery of goods
4.1. The goods are delivered via courier services, parcel terminals or can be collected at the location indicated by the Seller.
4.2. The exact delivery price and term are indicated at the time of ordering.
4.3. The Seller is not liable for delays if delivery deadlines are not met due to the fault of third parties or circumstances beyond the Seller’s control.
5. Quality of goods and guarantees
5.1. The Seller guarantees that all goods sold are of good quality and suitable for consumption within the indicated shelf life.
5.2. The Buyer undertakes to comply with the storage and use conditions of the goods.
6. Return and exchange of goods
6.1. In accordance with the Civil Code of the Republic of Lithuania and the Retail Trade Rules, food products, including sweets and other confectionery, of suitable quality are not returnable and not exchangeable.
6.2. Goods of unsatisfactory quality are exchanged or returned at the Seller’s expense if the defect occurred not due to the Buyer’s fault.
6.3. When returning a defective product, a purchase document must be provided.
7. Liability
7.1. The Buyer is responsible for the accuracy of the data provided when placing the order.
7.2. The Seller is not liable for losses incurred due to the Buyer’s failure to familiarise themselves with these Terms, although such an opportunity was provided.
8. Privacy and personal data
8.1. The Buyer’s personal data is processed in accordance with applicable legal acts and the Seller’s privacy policy.
8.2. The Buyer’s data is used only for order fulfilment and for improving the quality of services.
9. Final provisions
9.1. All disputes are resolved through negotiations. If an agreement cannot be reached, disputes are examined in accordance with the laws of the Republic of Lithuania.
9.2. These Terms enter into force when the Buyer confirms them at the time of placing the order and remain valid throughout the entire purchasing process.
